We hold the discretion to modify, add, remove, halt, or introduce new aspects to the Service whenever deemed necessary. Your usage of the Site and Service is subject to the current terms and conditions, and we may limit or restrict your access to the Service or any part of the Site at our sole discretion, without prior notice or liability.
3. Support
4Play Giveaway offers support to all officially registered Australian Business Partners in the 4Play Giveaway Network. For businesses interested in becoming a registered partner, please follow the relevant procedures as outlined on our platform.
4. Refund, Return, and Exchange Policy
Upon subscribing to a membership or making a one-time purchase on our rewards platform, you are endorsing the 4Play Giveaway brand. Please be advised that memberships or one-time packages acquired are not eligible for refunds.
Our products and services come with consumer guarantees as required under the Australian Consumer Law. In case of significant defects, you have the right to:
- Terminate your service agreement with us.
If the defects in the goods or services are not significant, you have the right to request corrections within a reasonable time frame. Failure to do so grants you the right to a refund and the ability to cancel the service contract. We cannot issue refunds or corrections for reasons like change of mind or misunderstanding of the services.
5. Account Creation and User Eligibility
To access specific features of the Site and Service, you'll need to register on the Site and establish a user profile or account ("Account"). Account creation is limited to individuals who are at least 18 years of age.
During the registration process, you'll be required to provide certain personal details such as your name, address, and email. You agree to supply accurate, up-to-date, and complete information, and any failure to do so will be deemed a violation of these terms and may result in the immediate termination of your Account. When creating an Account, you should not:

- Choose a username or email that is deemed offensive or inappropriate.
- Permit anyone else to use your Account.
6. Termination of Account/Cancellation Policy
You acknowledge that you have no ownership rights in your Account, and 4Play Giveaway has the discretion to discontinue the Service at any point. We may also cancel your Account and delete all associated information, including any content you have provided, without notice, for any or no reason. This includes but is not limited to, your violation of these terms. We shall not be held accountable for any losses stemming from the removal of your information from the Site or Service.
To cancel your account, simply send an email to termination@4playgiveaway.com requesting the cancellation. Upon receipt of your request, a unique cancellation link will be emailed to you within 24 hours. To complete the cancellation process, you must click on this link and follow the subsequent instructions.
Cancellation Policy for 4Play Giveaway Loyalty Membership
No Refunds: Please note that there are no refunds for 'loyalty membership' or 'one-off purchases'.
Cancellation Request Process: To initiate the cancellation of your account, please send an email to termination@4playgiveaway.com. Within 24 hours of your request, you will receive an email response with instructions to complete the cancellation process.
Processing and Effect of Cancellation: Once your account is cancelled, it will be fully terminated. All associated benefits, memberships, entries, and any other privileges will be completely revoked.
Handling of Personal Data: Post-cancellation, your personal data will be retained in accordance with the required Queensland legislation, ensuring compliance with all legal obligations regarding data storage and privacy.
No Further Charges: Upon cancellation, no further charges will be deducted from your account.
Permanent Cancellation: Be advised that once your account is cancelled, the action is permanent. There is no option for reactivation of a cancelled account.
Changes to the Policy: 4Play Giveaway reserves the right to modify this cancellation policy at any time. Any changes will be communicated to our members in a timely manner.
Discretion of 4Play Giveaway: You acknowledge that you have no ownership rights in your account. 4Play Giveaway reserves the right to discontinue the service or cancel your account and delete all associated information, including content you have provided, without notice, for any or no reason. This includes, but is not limited to, violations of these terms. We shall not be held accountable for any losses stemming from the removal of your information from the Site or Service.
Please note that once you cancel your subscription, reactivation is not supported through Stripe. All accumulated history associated with that subscription will be lost.
To unsubscribe from our mailing or text notification lists, please follow the opt-out links provided in those communications. These lists are managed by third-party services, and discontinuing your loyalty membership will not automatically remove you from them.
8. Membership Options and Loyalty Memberships

7. Eligibility Restrictions
9. Payment Clearance, Draw Participation, and Grace Period
Payment Clearance and Draw Participation: Members must have a valid and cleared payment on file to maintain active membership status and participate in any 4Play Giveaway draws. If a payment is pending or has not cleared by the date of any scheduled draw, the member's account will be placed on hold, and their entries will not be included in the draw. The membership and associated entries will remain on hold and ineligible for participation in any draws until the outstanding payment is made and successfully processed.
Payment Failures and Grace Period: If your account experiences a payment failure, our system will initially attempt to charge your account, followed by four additional attempts if the first one fails. These subsequent attempts will occur every five days, resulting in a total grace period of 20 days from the initial payment failure. During this grace period, the member's account will be considered on hold, and they will not be eligible for any draws. If the payment still fails on the fifth attempt (day 20) due to insufficient funds, your subscription will be terminated, and any loyalty streaks you have will be forfeited. This final failed payment will be treated as a cancellation of your account, meaning all benefits, memberships, entries, and privileges associated with your account will be permanently revoked, as outlined in our cancellation policy.
It is the member's responsibility to ensure timely payment to maintain active status and entry eligibility. 4Play Giveaway reserves the right to modify the terms of participation and membership status based on payment status.
10. Maximum Attempts for Charging Accounts
Take note that the system restricts the number of charge attempts to five, inclusive of any manual attempts initiated by the user.
11. Conditions for Using the Site and Service
You agree to comply with all relevant laws and regulations in your use of the Site and Service. You specifically agree not to:
- Upload or share material that infringes upon the intellectual property or privacy rights of others.
- Engage in or assist with any form of attack on the Site or Service, including denial-of-service attacks.

19. Member's Representations and Warranties

To participate in our Monthly Major Giveaway, you must be a registered member of 4Play Giveaway. This exclusive, members-only giveaway occurs on the 30th of each month, commencing from March 30th, 2024. 22. Terms and Conditions for 4Play Giveaway Jackpot Draws
1. Eligibility: Open to individuals 18+ at entry time. Employees of 4Play Giveaway, its affiliates, and their households are ineligible.

One-off Packages Memberships
These one-off packages, offer a limited-time experience of our platform tailored to your needs. 'One-off Purchases' are transactions made by users for specific products or services offered by 4Play Giveaway or its partner businesses without the need to subscribe to the ongoing Loyalty Membership. These purchases do not confer the ongoing benefits of Loyalty Membership and are typically singular transactions. One-off Purchases are not associated with recurring fees and do not automatically enrol the purchaser in any of 4Play Giveaway’s recurring giveaway programs or other subscription-based benefits.
'One-off Purchases' or ' One-off Packages' refer to individual transactions for specific products or services without a recurring subscription. They are characterized by:
Expiry of Entries: Entries from One-off Purchases expire after each Major draw/Royal Jackpot and do not count towards minor draws.
Affiliate Program and Refer a Friend Benefits: In affiliate programs or refer-a-friend schemes, 'Loyalty Membership entries' that are doubled count as 'One-off Purchases'. For example, if a member with 16 Loyalty Membership entries refers a friend who signs up for a Gold membership (8 entries), they receive 16 additional 'One-off Purchase' entries for the major draw, while the new member gets 8 such entries. Therefore, the referrer will have 16 entries for the minor draw and 32 for the major draw, while the new member will have 8 for the minor draw and 16 for the major draw.
Non-Transferability: Benefits from One-off Purchases, similar to Loyalty Memberships, are non-transferable and cannot be shared or transferred.
Available Tiers and Benefits:
Combination with Loyalty Memberships: If you purchase both a loyalty and a one-time membership, the days from the one-time membership will only become active after your loyalty membership has been terminated or cancelled.

- One-Time Membership & Promotions: Should you buy a one-time membership through a link that's part of an official 4Play Giveaway promotion within the promotional period, you'll gain a specific number of entries as set out for that particular package and promotion.
- Single Promotion Limit: Please note that purchasing a one-time membership via an official promotion link will grant you entries only for that specific promotion. It won't qualify you for multiple promotions.
- Loyalty Membership Benefits: If you're looking for the benefit of entries into all of 4Play Giveaway's members-only promotions, a loyalty membership is required.
- Additional Terms: The rules for entering promotional draws are governed by the individual terms and conditions of each respective promotion. These should be read alongside these membership terms and conditions.
Refer a Friend Program
- Eligibility for Referrers: To participate in the 'Refer a Friend' program, you must be an active member with a monthly loyalty membership at 4Play Giveaway. This program is exclusive to members with ongoing subscriptions, and does not apply to members with only one-off purchases..
- Reward for Successful Referral: When you, as an active loyalty member, refer a friend and they sign up for a monthly loyalty membership, you will receive double the amount of your current loyalty 'membership entries'. These additional entries will be added to your 'one-off entries' for prize draws.
- Benefit for the Referred Friend: Similarly, the friend you refer will also receive double the standard amount of 'membership entries' upon their successful sign-up. These doubled entries will be allocated to their 'one-off entries' for prize draws.
- Conditions of the Offer: The doubling of entries applies to 'membership entries' only, and not to any one-off entries that either party may have. Accumulating Entries for Promotional Draws
1. Accumulation of Entries: As a Loyalty Member of 4Play Giveaway, you accumulate entries each month based on the continuity of your subscription. The number of entries you receive is directly tied to your current membership tier at the time entries are calculated for a specific promotion.
2. Example of Entry Calculation:- If you maintain a Gold Membership for three months, you will accrue 24 entries for a specific draw (8 entries per month).
- If you downgrade to a Silver Membership in the fourth month, you will gain an additional 2 entries for that month. However, as you are now at the Silver tier, the total number of entries for that month will be limited to 8 entries, the maximum for Silver.
- Returning to Gold Membership in the fifth month will add 8 more entries, totaling 32 entries.
- Upgrading to Platinum in subsequent months does not retroactively increase entries for past months.
- Note: A Silver member can only have a maximum of 20 entries by the tenth month, as per the Silver tier's entry limit.
3. Entries Based on Current Membership Status: Entries are generated based on your membership level at the time of generating entries for a giveaway. If you have been a loyalty member for six months and have changed your membership level during this period, your total entries in a draw will reflect the membership level you hold at the time of entry calculation.
4. Maximum Number of Tickets: The maximum number of tickets you can receive per month is determined by your current membership tier. If you downgrade to a lower-tier membership in a particular month, your entries for that month will reflect the maximum number allowable for the lower-tier level.
5. Adjustments Due to Tier Changes: If your entries change due to alterations in your membership tier, they will be calculated based on your status at the time the entries are generated for a given promotion.
The above section details entries accumulated through 'Membership Loyalty Rewards', which are part of your monthly subscription. However, there's an additional way to gain more entries: 'One-Off Purchases'. These purchases provide extra entries that are exclusively applicable to the major draws.
'One-Off Purchases' allow you to extend the maximum number of entries you can have for the major draws. This maximum is inclusive of entries gained from various sources, such as:
- Promotional activities
- Our Affiliate Program
- The 'Refer a Friend' program
- Any 'One-Off Purchases' you make
It's important to note that these additional entries from 'One-Off Purchases' and other sources significantly enhance your chances in the major draws, offering you more opportunities to win.

- Employees, officers, directors, directors and their respective parents, subsidiaries, and their immediate families and/or those living in the same household are ineligible.

- Entry Method:
- Entry is available without a necessary purchase, but chances may be enhanced: a. Through the purchase of one-time memberships with various tiers. b. Through loyalty memberships offering continuous subscriptions to the platform.
- Phone or electronic entries shouldn’t exceed a cost of 55 cents.
- Internet entries should only bear standard internet access costs.
- The game’s advertisement will incorporate prize descriptions and guide participants to the terms and conditions.
- Prize & Promotional Draws:
- Prizes will strictly avoid restricted items by Australian legislation.

- Duration & Termination:

- Dispute Resolution & Limits on Claims:
- Disputes must be resolved individually. Class actions are prohibited.
- Claims are confined to actual out-of-pocket expenses. The Organizer won’t cover legal fees.
- Liability & Limitations:
- Direct or indirect damages arising from game participation aren’t the Organizer’s responsibility.
- Organizer’s liability is confined as per the Competition and Consumer Act 2010.
- Right to Modify, Disqualify, or Terminate:
- The Organiser can modify or end the game if compromised.
- Participants tampering with the game can be disqualified.
- Technical & Financial Issues:
- The Organizer isn’t accountable for technical mishaps.
- If a payment fails, the Organizer will try billing five times over 20 days. Failure results in revoked membership and benefits.
If you wish to change your current membership tier, you can do so through your 4Play Giveaway portal. Note that the change will be effective starting from your next billing cycle. No refunds will be issued if you downgrade or cancel your membership in the middle of a billing cycle. This applies to monthly memberships when paid monthly and applies to yearly memberships when paid yearly.
Ending Your Membership
To cancel your subscription, send an email to termination@4PlayGiveaway.com. We'll reply with a link that guides you through the cancellation process. Once you complete the process, you'll receive a confirmation email, and your membership will be terminated immediately. If you cancel in the middle of a billing cycle, no refunds will be issued.
Cancellation will not automatically remove you from our marketing communications. To opt-out, follow the "unsubscribe" link in our emails or SMS messages.
Failed Payments
If you're a Loyalty Member and we can't process your payment, we'll make four additional attempts to bill you every five days over a 20-day period following the initial failure. If we can't complete the transaction after five attempts, your membership and associated benefits will be revoked.
Membership Sign-Up Bonuses
From time to time, 4Play Giveaway may offer various incentives for joining, such as sign-up bonuses, special promotions, or free trial periods. These incentives are subject to their own specific terms and conditions. If you enroll in a free trial period and do not cancel it before it ends, your designated payment method will be automatically charged in accordance with the loyalty membership terms specified above, until you cancel your membership as outlined in these terms and conditions.
Change of Details
If there is any change in your personal details, such as name, address, contact number, email, or billing information, it is your responsibility to update it through your log in. Alternatively by emailing us at support@4PlayGiveaway.com. 4Play Giveaway is not responsible if you fail to notify us of changes, potentially affecting the full benefit of your membership.
Liability
While we do not exclude any rights or remedies that cannot be excluded or limited under the Competition and Consumer Act 2010, we and our partners shall not be liable, to the fullest extent permissible by law, for any loss or damage (including indirect, special or consequential damages or loss of profits), expenses, or for any personal injury, illness or death suffered in relation to your 4Play Giveaway membership, except where liability cannot be lawfully excluded.
Manner of Notifying Winners for 4Play Giveaway
Live Phone Call Announcement:
Facebook + Instagram Live: 4Play Giveaway will conduct a live video session on Facebook and Instagram where the winner will be dialed and informed about their prize. The audience will witness the live reaction, building excitement and credibility for the giveaway.
Backup: In the event the winner doesn’t answer the live call, a voicemail will be left informing them of their win and prompting them to check their registered email for further details.
Direct Communication to Winners:
SMS + Email: Following the live announcement, a formal congratulatory SMS and Email will be sent to the winner’s registered email address and mobile number. This SMS and Email will detail the prize they’ve won, instructions on how to claim it, and any other relevant information.
Public Announcement:
Website: The winner’s name (or pseudonym for privacy, if preferred) will be posted on the official 4Play Giveaway website on a dedicated ‘Winners’ page.
Other Social Media: Apart from Facebook, announcements will also be made across other 4Play Giveaway’s official social media profiles, like Instagram and TikTok, recapping the live announcement and celebrating the winner.
Terms & Conditions Acknowledgement: All notifications will include a reminder for winners and participants to review the giveaway’s terms and conditions, ensuring complete transparency and adherence to any guidelines set.
Claim Period Reminder: Alongside the congratulatory message, winners will be reminded of the time frame within which they must claim their prize. Should the prize remain unclaimed within this period, 4Play Giveaway may, according to its terms, choose another winner or decide upon another use for the prize.
Winner Announcements on Social Media:
By participating in our draws, winners agree that 4Play Giveaway may tag their Instagram handle in our winner announcement posts. It is the responsibility of each winner to inform us promptly if they prefer not to be tagged in such posts. Winners must communicate this preference to us as soon as possible after being notified of their win.
In the event that a winner does not inform us of their preference not to be tagged before the announcement is made, 4Play Giveaway shall not be held responsible for any consequences that may arise from the public tagging on our Instagram or other social media channels.

If the dispute is deemed not valid, the complainant will be informed accordingly with an explanation.

For valid disputes, a thorough investigation will be conducted. This may involve seeking further information from the complainant, involved parties, or third-party sources.
The investigation will be objective, impartial, and confidential.
- Step 5: Resolution
Based on the investigation’s findings, the Dispute Resolution Team will propose a resolution.
This could involve a corrective action, a compromise between parties, or other suitable measures.
The proposed resolution will be communicated to the complainant and all involved parties.
- Step 6: Implementation
Once a resolution is agreed upon, necessary actions will be implemented promptly.
All parties will be kept informed of the progress and outcomes.
- Step 7: Closeout

5. Appeals
If a party is not satisfied with the resolution, they can appeal the decision within 10 business days of receiving the resolution proposal.
